Terms of Service - ABAB Cam

1. Introduction

Welcome to ABAB Cam ("ABAB Cam", "we", "us", or "our"). ABAB Cam is a website and mobile application that helps users discover and view publicly available webcams, livestreams, news streams, map markers, and related third-party video content from around the world.

By accessing or using ABAB Cam, including our websites, mobile apps, and related services (collectively, the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. Who We Are and What We Do

ABAB Cam is operated by ABAB Labs. The Service aggregates and organizes links, embeds, thumbnails, stream metadata, and map information from third-party providers, including webcam operators, video platforms, public data sources, and map providers.

We do not own or operate most cameras or streams. We do not control third-party stream availability, quality, legality, accuracy, privacy practices, or content. Third-party content remains the property and responsibility of its respective owners.

ABAB Cam is a discovery and viewing tool only. It is provided for informational and entertainment purposes and must not be relied on for emergency, safety, security, surveillance, travel, navigation, financial, legal, or professional decisions.

3. Eligibility

You may use the Service only if you are at least 13 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the mobile app on devices you own or control, solely for personal, non-commercial use and as permitted by the app store rules that apply to your download.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Service except where such restriction is prohibited by law.

5. App Store Terms

If you download ABAB Cam from the Apple App Store, Google Play, or another app marketplace, that marketplace's terms also apply. If there is a conflict between these Terms and the marketplace terms, the marketplace terms control only to the extent required by that marketplace.

For apps downloaded from the Apple App Store, Apple is not a party to these Terms and is not responsible for providing maintenance, support, warranties, claims, investigations, or compliance related to the Service. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

6. Acceptable Use

You agree not to use the Service to violate any law; access cameras, streams, systems, or accounts without authorization; bypass technical protections; stalk, harass, identify, target, or harm any person; collect personal data about others; overload or disrupt the Service; scrape or automate access in a way that harms the Service; or use the Service for unlawful, defamatory, hateful, invasive, or otherwise harmful purposes.

The Service may display a visual RECON Toolkit or similar interface elements. These are disabled visual elements only. You may not use ABAB Cam to scan networks, test vulnerabilities, attack systems, or conduct unauthorized reconnaissance.

7. Third-Party Content and Links

Many videos, streams, map tiles, images, and links available through ABAB Cam are provided by third parties. We do not endorse, control, or guarantee third-party content or services.

Your interactions with third-party services are between you and those providers. You are responsible for reviewing their terms, privacy policies, copyright rules, and community standards.

A stream may be unavailable, removed, blocked, delayed, inaccurate, or inappropriate without notice. We may remove or disable access to content at any time.

8. Intellectual Property and Reports

We own the ABAB Cam brand, logo, interface design, website and app code, and our original content. Third-party streams and related content remain owned by their respective rights holders.

If you believe content accessible through ABAB Cam infringes your rights or should be removed, contact us at support@abablabs.com with enough detail for us to review the issue, including the URL or stream title, the rights or concern involved, and your contact information.

9. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Service, you acknowledge our Privacy Policy.

10. Accounts, Payments, and Subscriptions

The current version of ABAB Cam does not require user accounts, paid subscriptions, or in-app purchases for the core viewing experience. If we add accounts, paid features, subscriptions, or in-app purchases, additional terms may apply and will be disclosed before purchase or account creation.

11. No Professional Advice

Nothing in the Service is investment, legal, tax, safety, emergency, security, travel, or professional advice. You should consult appropriate professionals or official sources before making important decisions.

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service or any third-party stream will be accurate, complete, available, secure, uninterrupted, or error-free.

Use of the Service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, ABAB Labs and its affiliates, officers, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, personal injury, property damage, or third-party content issues arising out of or related to the Service.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless ABAB Labs and its affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, your violation of law, or your violation of third-party rights.

15. Changes, Suspension, and Termination

We may modify, suspend, or discontinue any part of the Service at any time. We may also suspend or terminate access if we believe you violated these Terms or created legal, security, operational, or reputational risk.

We may update these Terms from time to time. When we do, we will update the "Last updated" date. Changes are effective when posted unless otherwise stated. Your continued use of the Service after changes are posted means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.
